Expedia, Inc. Requests Arbitration and Mediation for Expedia.nu with World Intellectual Property Organization (WIPO)

Expedia, Inc., which owns the trademark for the word expedia, has challenged the Swedish based company’s registration of the domain name expedia.nu with .NU Domain Ltd.

Whois is commonly used to search for domain names and determine if they are available to register or not.

“When the domain name registration systems were initially set up, domain name registrants were generally corporations or research and educational institutions,” said J. William Semich, President and Founder of .NU Domain Ltd. “Now millions of private individuals, and not companies, are registering the majority of domain names. And many of these users are under the age of 18. Policies need to be established to protect these individuals from spam, or from harassment and stalking, by anonymous people who gather personal information from publicly accessible Whois databases.”

Under .NU Domain’s Privacy Policy, only a domain name, its status and the date of its registration is made available via the .NU public Whois database at whois.nic.nu. Under the .NU Domain Privacy Policy, if someone such as a law enforcement organization or a trademark attorney, needs contact information about a domain name holder, the person is required to submit a statement to .NU Domain Ltd identifying who they are, and why they need the information, before private information is provided to them. If they can not justify a valid need for this information, the information is withheld.

“We believe that anonymous persons should not be able to have open access to all information about anyone who has registered a .NU Domain name,” added Semich. “We have a requirement that all contact information about a domain name holder must be valid and verifiable. But by not protecting our customers’ privacy, we are making it difficult for many of them to comply.”

As an example, when a recent registrant for a .NU Domain name who registered the name for a Teen Rock and Roll Fan site provided unverifiable contact information for the name, it was deactivated and put on “hold” status while the customer was asked for valid information. The customer – a 15-year old teenager – declined to do so in order to protect her privacy. Under these new terms, the customer has agreed to comply and has provided full contact information for the domain name.

William Semich, has been appointed to the Names Council of the Internet Corporation for Assigned Names and Numbers’ (ICANN) Domain Name Supporting Organization (DNSO). Semich was appointed to represent the Asia Pacific ccTLD (country code Top Level Domain) constituency members. He is one of only three ccTLD appointments to the 18 member Names Council.

The DNSO is one of three Supporting Organizations called for in the ICANN Bylaws. SHERBORN, MA, April 21, 1999 — The .NU Domain Ltd, the fastest growing domain on the Internet, today announced that it has shut down domain name server support for a rogue Internet entrepreneur who has reportedly been copying legitimate web site addresses and pointing them to his pornographic web sites.  The company also put the rogue Internet entrepreneur on notice that all of the .NU domain names he has registered will be revoked if he does not publicly come forward and completely identify himself within 24 hours.

This Internet hacker has registered 25 domain names with the .NU Domain Ltd over the past few months.  He also signed up to use .NU Domain’s InstantWeb service for his domain name server support.

In addition to being the exclusive registrar for .NU domains on the Internet, .NU Domain Ltd offers an additional line of business called the InstantWeb, which helps small office/home office users get up on the Internet quickly and easily.

“By using our InstantWeb name servers to point to his real web site, the hacker had hoped to hide his Web’s location and keep it from being traced,” said J. William Semich, president of the .NU Domain Ltd.

However, by using an Internet Protocol (IP) address ‘who is’ lookup service at www.arin.net, similar to the lookup used to track down the Melissa hacker, the .NU Domain Ltd determined that the bogus web sites were actually being hosted by an ISP in Wisconsin.

The registrant of these 25 domain names, who has listed his name as Carlos Pereira and his location as Portugal, has been given 24 hours notice to verify the information in his domain name application.  If he can not do that, then the 25 domain names will be revoked completely.

The .NU Domain Ltd has provided information to the original complainant who’s web site has been hacked, on how to contact the ISP, in order for him to take action.

“This kind of use is a direct violation of the .NU Domain’s InstantWeb service’s anti-pornography policy,” said Semich. The .NU InstantWeb provides name server services, e-mail forwarding, web forwarding and mini web hosting services.  Its policy excludes the use of the InstantWeb for pornographic material.

In addition, the terms and conditions of use for registration of a .NU domain name requires that all contact information for registrants be complete and verifiable or the domain name risks being revoked.  The policy also precludes use of .NU domain names for any unlawful purpose, for spamming or for trademark violation (www.nunames.nu/pricing.htm).

“We began investigating this matter as soon as it was brought to our attention.  It is uncertain if the domain names are being used for unlawful purposes, but if that is proven by a responsible authority, the domain names will also be revoked immediately,” said Semich.

SHERBORN, Mass., Oct. 2, 1998 – In response to the White House’s request to draft language to address the concerns that the .NU Domain Ltd (www.nunames.nu) has raised regarding the latest bylaws for the new IANA Corporation, the .NU Domain Ltd today proposed modifications to the bylaws that would give budget approval powers to the groups that will fund the new corporation — its Supporting Organizations.

“The basic problem with the latest of the new IANA Corporation’s bylaws is the apparently-intentional lack of board accountability to the public,” said J. William Semich, president and chief financial officer of the .NU Domain Ltd. “The result will be an organizational structure similar to an independent public authority”.

“The language we are proposing for addition to the bylaws will guarantee spending controls and fiscal accountability for the new IANA, including budget reviews, a bond review process, limits on spending levels, and a budget monitoring and approval process,” continued Semich, “while still assuring continued stability of the Internet services IANA currently provides.” Semich is the former chairman of the Finance Committee of the Massachusetts Bay Transportation Authority (MBTA) and co-author of “Inside the Shadow Government,” an award winning investigative article on public authorities.

The language of the proposed modifications to the IANA bylaws was jointly developed by Semich and .NU Domain Ltd’s corporation counsel, Harold J. Carroll, a partner at Gadsby & Hannah LLP in Boston. Carroll is the former Chief General Counsel of the Boston Redevelopment Authority and former Corporation Counsel for the City of Boston.

In a letter sent today to White House senior advisor Ira Magaziner, the NTIA and IANA (and which can be viewed at http://www.nunames.nu/spending-controls ), the .NU Domain Ltd’s proposed additions to the IANA bylaws call for the following requirements:

That the Corporation submit an annual budget request and service plan to the Supporting Organizations for review and approval or reduction;

That all long-term bonding or bond refunding requests receive a 2/3 majority vote of by the Supporting Organizations;

That the Corporation manage annual spending levels to stay within its approved annual budget;

That a guaranteed, maintenance of effort, level of funding be provided to the Corporation regardless of any budget reductions voted by the Supporting Organizations, in order to assure the IANA’s existing level of services are maintained. The base “maintenance of effort” level of funding is taken to be the current annual spending by IANA under its contracts with the US Government;

That the Corporation makes all its spending and other information available to the Supporting Organizations as part of the budget monitoring and approval process.

The current US Government agreement with Network Solutions Inc. and the University of Southern California’s Information Sciences Institute (ISI) to manage IANA is set to expire shortly. “It these provisions are included in the bylaws to the new IANA Corporation, it would go a long way to assuring public accountability,” concluded Semich.
